Cab tech firms seek move of Uber price-fixing class action

Curb, Flywheel, CMT/ARRO ask San Jose judge to shift NY rider’s Sherman Act suit; Uber called ‘elephant in the room’.

Taxi technology companies offering cabs through Uber want a California federal class action over alleged price-fixing transferred to New York.

Courthouse News reports defendants Curb Mobility, Flywheel Technologies, Creative Mobile Technologies and ARRO told Magistrate Judge Virginia DeMarchi that plaintiff Brendan Kretschmer lives in Brooklyn, used Uber there and any harm was in New York. Kretschmer claims cab firms colluded via Uber’s app to lift all ride prices under the Sherman Act; Uber is not named because its user agreement would force arbitration. Defence argues third-party arbitration language may cover providers; plaintiff’s counsel says it does not. The judge called Uber the “elephant in the room” and reserved a written order.
